I have received in ref a, excuses from a government bureaucrat refusing to perform his duty. His poor excuse is rather then using his subpoena powers to obtain from the Sussex County Soil Conservation District’s field inspectors, manager and chairman, executive secretary of the State Soil Conservation Committee and the Stanhope’s prior Borough Engineer, Construction Code Official and Code Enforcement Official to pass the buck to some lawyer I should obtain. I have in a futile attempt using the lawyer referral service already called lawyer after lawyer as they are overwhelmed by the task before them. I have paid over $300 just to have a lawyer listen to my complaints which would have paid his fee for 1 hour but he could not believe the corruption that lay before him as I presented the evidence. His regard for the lawyers within State and municipal government which he had held in high regard collapsed around him like flies on a 18 wheeler going 90 miles per hour. After our discussions which lasted two hours he held his profession in disgrace.

 

The same can be said for the Commission of Investigation as they had a staff member, Ms. Gore visit my house years ago for 1 hour as I lay on my dining room  table the untold flaws in the Soil Erosion and Sediment Control Act and its administrative code. Apparently the level of incompetence and understanding of governance and control is not understood by anyone in the New Jersey State Government.

 

The law is abused on purpose. The law is written solely for the developer’s sake and not the citizens as a 3rd party appeal by the citizens to the State Soil Conservation Committee is block by the very way the law is written and completely and utterly corrupted by the guardian of the Committee by its apparent criminal executive secretary of the State Soil Conservation Committee Mr. James Sadley that after reviewing by OPRA the Sussex County Soil Conservation Board of Supervisor minutes shows utter collusion to circumvent any and all requirements contained within what an applicant must submit for its application to be even considered pursuant to N.J.A.C. 2:90-1.4, 1.5 and 1.6. The application, procedure and appeal process is so circumvented as to make the entire process of review and governance meaningless and to serve as a protection racket by the Department of Agriculture to assure the public is denied all proper reviews and any process of executive control.

 

Via OPRA the HQ, Department of Agriculture after stalling and only through great persistence was forced to admit in its OPRA response by Mr. Louis Bruni via my OPRA Request #C20517 that is was stripped of its garments to its bare ass and that is what they are.

 

The executive secretary has conspired with its corrupt Sussex County Soil Conservation District and SCSCD’s use of kangaroo courts to plan its treasonous acts to use the criminal court system to threatened, jail, fine and intiminate witnesses to its corruption by a developer E.N.F. Development Co. LLC that conspired within the Department of Agriculture, Sussex County Soil Conservation District and the Borough of Stanhope’s Governing Body, Town Administrator and Municipal Prosecutor and Chief of Police to undermine all Land Development Codes and use its executive powers and with the support of cooperative judges and prosecutors to even deny the defendant to call any witness in their defense.

 

The Sussex County Soil Conservation District’s lawyer even boast how he is using the cost of transcripts of the “kangaroo court trail” to prevent an appeal and the cost of that appeal to prevent me from presenting grievances and using my “excellent performance” awards which were given to me by my commander’s to protect our national defense as I was given the great honor of leading two national defense emergencies at the same time with the power of the four star general of the U.S. Army Material Command to build a new nitroglycerin manufacturing facility as an old batch plant blew up and the other production facility was behind construction schedule and the other plant construction with over 1,200 construction workers on site while I worked for the U.S. Army Material Command, I was assigned as the Corps of Engineer’s technical advisor as I “took foreign technology” of a complex manufacturing facility on an index card and told my supervisor what you have won’t work, I will build you a production plant on based upon the notes on this index card. The only question  was how much and when. I said $50 Million and now and that was it. On the nitroglycerin plant I was “strike team” leader and I said what does that mean. You are the President, proceed with all do haste. I saw my Technical Director of the Project Manager for Production Base Modernization and Expansion and said: “You have 20 seconds, sign this.”. It was to proceed with the design for a nitroglycerin production plant and he lifted the top page and there was no second page. He said: “Tom where is the scope of work?” I said: “ You have 10 seconds left or I’ll sign the authorization, I write the scope of work on the airplane. Two seconds later the “scope of work” was signed.

 

Executive Directive Rockoff gives nothing but excuses for not performing his duty which is as required subpoena witnesses and recommend changes to the legislature to prevent the contamination in the very law designed to protect the public from developer’s who flaunt the law as they are protected by the State government, the local government and the state police force as they just pass-by the developer’s construction site as sediment is tracked onto our major highway through Stanhope. Tons of sediment an environment pollutant as defined by the legislature in their own law litterly flow onto the highway as state troopers drive past and the Stanhope Chief of Police refused to do anything when I confronted him.

 

Pathetic. The stench reeks. Every property owner signed a petition to comply with laws and site plans and Stanhope used its police to pound on my door with letters I was banned from Stanhope. Sussex County Soil Conservation District’s chairman and manager used prosecutors and corrupt judges to convict me on multi-counts without even allowing me to call witnesses and I was convicted because I co-signed a letter with two other people who sat in the front row of the court and were not allowed to be called as witnesses and the letter to the New Jersey Attorney General was to investigate corruption that you responded to me over 1 month ago and I have heard nothing from the Criminal Justice system.

 

The law states time is expired after a given length of time. The developer submits nothing required in the requirements for an application, no fee, no plan, no calculations, nothing and Mr. Sadley let’s the time expire and says the words “incorporate Lot 12” are approved by time expiration and no one is notified except themselves not the developer or the municipality. And utter disgrace. If need be add the words, “after a complete application is submitted.” That should be understood? If nothing is submitted how can “the nothing” be approved by time expiration.

 

The District’s attorney is so hideous he boasts of using the criminal justice system to deny complaints by aggrieved parties. The Borough of Stanhope bans you with threats of criminal harassment and criminal trespass and when you submit an OPRA form to get the evidence of government documents that required legal documents don’t exist, they refuse to respond, you file a denial of access complaint with the GRC and in the Stanhope SOI they lie and also tell the GRC you are a criminal. GRC’s response from its executive director is “they can only do denial of access” while the Borough of Stanhope actively supports and using its police force to threaten the witnesses and the public which is adversely impacted in its private property and harmed psychologically.

 

Executive Director Alan Rockoff with his powers, rather then issuing subpoena to force testimony under oath so the laws can be changed or even have a staff member listen to the public what should the changes be responses: Go see lawyer. Done did that, now what.

 

I suggest you either have executive director Alan Rockoff replaced or give him a clue as to what performance of his mission and duties are.

WE need more Arthur Russos, the executive director of the Board of Engineers, as he immediately started investigations against the developer’s two professional engineers and the State’s professional engineer and expanded his investigation against the corrupt prior Stanhope Borough Engineer.

 

Mr. Russo should make a training tape that is distributed to your executive branch that reminds the bureaucrats of their duty which is to protect us, allow us to live in an era of general welfare and tranquility that doesn’t have municipal and state government activity cooperate together against the people and others that avoid their mission responsibilities. WE need a better government that is responsive to the people as we are tired of waiting YEARS.
