Dear Mr. Bruni,
It has been a pleasure communicating with you in the past
Mr. Bruni as you have always provided excellent service as an OPRA custodian.
In addition, I appreciated the opportunity in discussing at length with Ms.
Erin Simone, esq. numerous detailed aspects of the State Soil Erosion and
Sediment Control Act and its standards that need improvement. I also discussed
with her the Title 40 considerations, Stanhope Chap 100-119 and N.J.A.C.
2:90-1-14 Minor Subdivision and other legal and procedural aspects.
I prepared a 20 plus page detailed report reviewing some of
the State Codes in an analysis that is available via the Internet at a web site
I created for education as I am now preparing guidelines and other materials as
I indicated to the Department of Agriculture in my work breakdown structure
analysis of State agencies and Stanhope as an example as a free service to be
published on the internet as a global community neighborhood of the world after
peer review by professional societies, universities and government. These
graduate and undergraduate courses will be available for download free to any
instructor and student or citizen and be provided in multiple languages.
Unfortunately, I am unable to inform the public of
classified facts and can only “educate” and “mentor” and suggest changes in
laws that do not divulge the classified knowledge of mathematics and knowledge
of structures, permafrost, mud, soil, sand and other material and scientific
properties and mathematical analysis known to appropriate engineers and
scientists with a “need-to-know” as noted in the background I provided my web site.
I am unable to correct the many errors I have seen in the
peer review journals such as the Soil Science Society of America of which I was
a member which were written by team of
PhDs and scientists as it the information is not publicly available.
I have attached some data which has already been provided to
the Governor’s POC, U. S. Attorney’s Office, Commissioner of the DEP and Mr.
Larry Baier her representative on the State Soil Conservation Committee who she
assigned in my request to her as she was kind enough to bring the then
Commissioner of the DEP to met me in the DEP cafeteria. That letter is on the
web site: thomascaggiano.com along with other information Ms. Simone may find
useful as I expect to introduce changes in State law via the courts as my
efforts with the Department of Agriculture and State Commission of
Investigation were not beneficial as noted in my letter to the Governor on the
web site.
Please share the attached information with Ms. Simone and I
look forward to a future of our team working together harmoniously to benefit
all those who live in and visit our state.
Thank you again for all the courtesy both of you have shown
me as our community leader. I am also
providing your letter as I have made some annotations on a copy that I have
shared with our Governor and others.
I discussed various actions with the Governor’s aide, the
U.S. Attorney’s Office, the New Jersey Attorney General’s office, the Borough
of Stanhope, Honorable B. Theodore Bozonelis secretary (Superior Court assignment
judge) and Commissioner of Department of Consumer Affairs Susan Levin’s
secretary. Stanhope new outstanding municipal clerk and OPRA custodian has
provided me access to Stanhope records in spite of Stanhope’s illegal directive
written by its Town Administrator Teri Massood with the assistance of its
Borough Attorney / Municipal Prosecutor Richard Stein. In similar fashion to the Department of
Agriculture HQ and Sussex County Soil Conservation District, the Borough of
Stanhope’s Mayor in a public town council meeting as the audio recording I
obtained under OPRA is available on the web site as I was limited to 5 minutes.
Even through the Director of Consumer Affairs Ms. Ricketts has Mr. John Cilo
Jr. Stanhope’s prior Borough Engineer (if he had a legal contract under the
Local Public Contracts Law), SCSCD’s professional engineer Mr. Joseph Sedivy
who also based upon my review of 4 years of his contracts none were awarded per
the Local Public Contracts Law nor per its auditor’s reports does SCSCD comply
with any United States accounting standard.
Mr. Inhoffer, Mr. Schneider and Ms. Keith are also under investigation
by the Department of Consumer Affairs and I have the “confidential data” which
is listed on the web site. Strangely, none of these agencies are interested in
accepting my repeated offer to discuss the data that the Director of Consumer
Affairs referred to the U. S. Attorney’s Office and the New Jersey’s Criminal
Justice Department or even to your Director Ms. Monique Purcell. According to her
assistant, I apparently sent in so much evidence via fax as the more then 100
emails I sent were deleted but as a COOP they are in the Department of
Community Affairs Codes and Standards department of investigators to see what
information was provided in the feet of evidence of which I was convicted at
the “hands” of SCSCD’s chairman Mr. Lundin and Ms. Straub. As I recall at the meeting I had with them
at the appeal which is noted on the web site, although not mentioned in their
minutes, Mr. Lundin, an attorney, prior Mayor of Hopatcong where I was
convicted as his photograph is on the wall in the courtroom, GROANED aloud when
after reading the letter written by Mr. and Mrs. Pawar who Mr. Brian Smith
wrote to me they were both shills when they provided SCSCD a copy of their
observations of the Oak Drive development which they had sent previously to the
Board of Engineers as its excellent executive director Arthur Russo also added
05-13a and 05-13b complaints against Mr. Cilo.
Stanhope’s order banning me was determined to be illegal by
the Government Record Council panel of Governor’s appointees and found to have
willfully violated State laws.
Per OPRA the penalty may be $83,500 as 18 complaints were
filed as noted on the GRC web site, I had as many against Stanhope as the GRC
received from the entire state.
I drove down to attend the meeting and while my time was
extremely limited in the public comment period as noted on the web site, the
GRC did take appropriate action by canceling the State’s scheduled monthly
meeting for the entire state regarding its Jun 2006 meeting to incorporate
changes I suggested to its executive director Ms. Starghill and the Department
of Community Affairs commissioner.
In recent discussions with that Department, I understand the
concerns that 15 property owners in Stanhope identified regarding criminal and
illegal developments by E.N.F. Development Co. LLC in our May 8, 2006 letter on
the web site and notification by our OPRA custodian that she, Ms. Robin Kline,
even after consultation with the Town Administrator Teri Massood who duties
include insuring compliance with laws and monitoring contracts and requesting
numerous times with Mr. John Cilo Jr., Mr. Eric Keller and Ms. Doyle are ALL
unable to find any existing 2006 contract for any of these professionals?
Per the Map Filing Law as I noted to the Department of
Community Affairs, as there is NO municipal engineer in Stanhope this year NO
Soil Erosion and Sediment Control Plan, site plan or map is a valid document
and all construction in the Borough of Stanhope must stop immediately as I
informed the Mayor, Governing Body, Borough Attorney, Town Administrator, Land
Development Board and powerless Stanhope Environmental Commission. I even
provided them all irrefutable evidence of criminal acts as both SESCPs prepared
by E.N.F. Development Co. LLC. As I noted repeated to HQ, Department of
Agriculture and Sussex County Soil Conservation District were criminal
submission, for only 1 Lot, not the project and neither HQ, Department of
Agriculture nor SCSCD have any data as required per the “application
procedures” as you noted in your previous excellent response of what
information was available to HQ, DA as SCSCD has no such data either.
Apparently the issue was of such great concern to the
buyer’s of Block 10902 Lot 12, 6 Oak Drive that Mr. Lamicella wrote directly to
the Secretary of Agriculture’s assistant Ms. Tovar as he could see boulders,
sediment in his neighbors yards which came from 6 Oak Drive during its
development which occurred on both lots before I brought the 2 Lot sub-division
project to SCSCD’s attention as noted in SCSCD’s own minutes of my meeting and
as noted in a letter on the web site, on Jul 25, 2002 all the surrounding
property owners stated comply with Land Development Codes, the site plans,
grading profile and restore trees. In the newspaper article it noted a wall was
failing and as stated dozens of times there is no 150 ft long wall that is 8 ‘
tall on the site plan nor is there their another lower wall in the restricted
deed conservation area marked with a heavy line.
As I showed Assistant Commissioner Lisa Jackson with Mr.
Frank Minch of the State Soil Conservation Committee standing next to her as
she was seated when I showed them both a large photograph I had taken from my
bedroom window that a smaller version is enclosed. The rear deck was built on the wrong side of 6 Oak Drive but the
SESCP certified by Mr. Lundin shows the deck on the north side of the house. In
addition, neither of the two walls the SCSCD field inspector’s Mr. Krause and
Mr. Morris are observing are on either of the two-foot slopes contour maps that
are certified for only one lot and neither is approved by Stanhope. Per the
Land Use Board, no variance request was made to change the slopes, the wetland
was buried BEFORE SCSCD knew about the project and I got a sinkhole as
confirmed in our letter signed by 14 people.
None of these individuals were ever contracted by HQ, DA or
SCSCD and SCSCD refused any meeting with them dozens of times.
That is all history. In my conservations last week, I was
made aware our concerns regarding Stanhope were made to the Department of
Community Affairs from the Governor’s representative and that Department after
getting over 3,000 pages of evidence is undertaking some action.
The Sussex County Prosecutor’s Office recused itself from
any criminal investigation after I presented some data to that office and met
with its staff on Jun 14, 2006.
I believe that the U. S. Attorney’s Office may consider an
investigation and based upon Senator Lautenberg’s introduction (letter on web
site) I met with Mr. Nobile and Mr. Beet for two hours in Nov 2005 and have
been providing them hundreds of pages of evidence I have gathered during my
five (5) year investigation of State agencies, court proceedings in Stillwater
and Hopatcong where I was convicted without being given the opportunity to have
witnesses based upon the complaints filed by Mr. Lundin and Ms. Straub as I
provided them more then 100 emails and also Mr. Sadley and Mr. Minch. I also
provided significant data to Ms. Tovar and Secretary of Agriculture and Ms.
Monique Purcell the Director of Agriculture without ever getting any response
other then from Colleen, “you used up our fax toner” or “use sent us so many
faxes you shut down the department”. I
was convicted of harassment for sending vast quantities of evidence previously
to SCSCD. Now I just send mail reams of evidence through SCSCD’s Mr. Smith who
wrote me that Mr. and Mrs. Pawar were shills and when they faxed him evidence.
He destroys the evidence apparently stating to me in a letter that he, Mr.
Smith, uses the back of the faxes as scrap paper before throwing the
information away in the trash.
Previously in a meeting with Stanhope’s Town Administrator who wrote the
many threatening letters to me banning me form Stanhope under threat of
criminal convictions (been there done that) that were determined to be illegal
(criminal) also stated to me in a meeting with the Code Enforcement Official
Ms. Arlene Fisher, that Ms. Massood Stanhope’s Town Administrator threw my
letters to Stanhope in the trash.

9 – 11.
